A Commissioner of Oaths is Someone Who....

  • Is certified to endorse affirmations and declarations; they can also take and receive affidavits or administer oaths.
  • Affixes a stamp certifying that the required oath, affirmation or declaration has been properly administered.
  • Does not certify the truth of the statements contained in a document. This responsibility remains with the client.
  • Is not responsible for the content of the affidavit. It is the responsibility of the person whose signature is being commissioned (i.e. the client).
  • Is not a Notary Public. A Notary Public has all the powers of a Commissioner of Oaths and can also endorse documents to be used outside of the Province. A Notary Public is generally a practicing lawyer and can witness, certify and attest business documents, contracts, and property deeds. It is the responsibility of the client to ensure a Commissioner of Oaths can sign the documents.

The Client

The person swearing or affirming to a document must appear before the Commissioner for Oaths. Proper identification (photo ID) such as a valid driver’s license, current passport, permanent resident card or any other government issued photo identification must be presented as well as, the completed affidavit with the exception of the signature.  The signing of the affidavit must be completed in the presence of the Commissioner.
